The yellow-shirt Network of Thai Patriots hasdemanded the government push Cambodian people out of the disputed area aroundPreah Vihear temple within 24 hours and immediately revoke the border memorandum of understanding signed in 2000 and the Joint Survey and Demarcation of Land Boundary accord signed in 2003.

Chaiwat Sinsuwong and Veera Somkwamkid, co-leaders of the yellow-shirt civil network, led a group of about 50 demonstrators to Government House on Wednesday to submit a complaint to Prime Minister Abhisit Vejjajiva. The complaint was received by a Government House official.

“The government must quickly revoke all the Thai-Cambodian agreements that put Thailand at a disadvantage, expel the Cambodians from the Thai territory and fulfil former prime minister Sarit Thanarat’s desire to retain  ownership of Preah Vihear temple,” Mr Chaiwat said.

The network had pressed the government to follow its demand on Tuesday, but the government deceived  the public by saying it needed more time to solve the border issue, he said.

He said the border demarcation was unclear and at odds with the natural watershed.

The network now demands the government drive the Cambodians away from the Thai border within 24 hours and cancel all agreements with Cambodia,” he said.

  • Prime Minister Abhisit Vejjajiva tells the United Nations that letter of Cambodia’ Prime Minister Hun Sen to the UN concerning Preah Vihear controversy is “misquoted, taken out of context and misunderstood.”

Doesn’t Thailand have  any law to guarantee press, media in order to secure freedom of press, expression and at the same time to secure social and political order, reliable information, reputation, and culture?  Hun Sen often quoted his sources from the Nation and Bangkok Post which are the pro-Abhisit’s media and Abhisit always accuses him of being misinformed and misunderstood. So if it is misquoted, it is not Hun Sen’s mistake, but it must be the media that disseminate the wrong information with purposes and they must be held responsible for their crimes as stated by Thailand’s Constitution, Article III pertaining to the Rights and Liberties of the Thai People in Section 36. Or Abhisit must ask them to publish correction for it is a very sensitive issue. But he always fails to do so which makes Sawai Boonma’s Guide to the Perfect Thai idoit perfectly correct about Thai people..

After denying the fact he said that he would use both diplomatic and military means to retake Preah Vihear temple and its surrounding lands he then softened his stance to Cambodia by declaring that he would stick to peaceful and bilateral resolution on border conflicts with Cambodian. But immediately he again bullied Cambodia by DEMANDING that Cambodians must leave from his so-called created  disputed areas.

“We have to tell them (Cambodians) to leave,” Abhisit told reporters. “They have trespassed so we are trying to evict them.

“The problem happened because Cambodia intruded into Thai territory so we have the right to protect our sovereignty and we will do everything possible through peaceful means.”

NOTE: To be civilized, I want to ask him that:

  • Please tell us from which area must we leave? Please show us where Siamese lands  have we trespassed? Please let us know which map does he use to prove that the lands that we live around Prasat Preah Vihear belong to Siam? Please show us from which document/ treaty/reference does he use to prove that those areas are under Siamese sovereignty?
  • How can he be willing to solve the border conflicts peacefully, while he arrogantly demands another sovereign nation to accept his unilateral drawn map  by ignoring the spirits of international treaty, MoU, law, verdict, and agreements?
  • It is even more ridiculous, self-contradicted, and nonsensical to listen to him because how can he say that we trespassed Siamese lands while he call it a disputed areas? He must be insane!!!

So think about this if  it is acceptable for any nation on earth.

NOTEAbhishit must understand that:

  • Cambodia doesn’t have her own drawn map. The map that Cambodia uses until today is the product of Siamese-French committees who conducted the border research and survey which agreed and signed upon in 1908 in accordance with Siamese-French treaties 1904 and 1907. So why do you refuse your own product? Legally, this map is legitimate in both national and international levels as justified by ICJ 1962 and proved to be more widely recognized in 2008 by the WHC.
  • If you accepts only the map that unilateral drawn and recognized by Thailand, so how about Cambodia? It’s like you are demanding us to accept your robbery of our land and property without fighting back. And if everyone just thinks the way you are, then there will be no peace.  If so, why do we need to have international treaty? And what is the use to have MoU?
  • In fact, MoU clearly states in its article I that the border resolution of the two countries must be surveyed and demarcated basing on the Siamese-French treaties. And therefore, Thailand must live with the facts. However, if I were the leader of Cambodia today, I would warmly welcome the 2000 MoU revocation and you would have no chance to bully around like this.

Then Abhisit, illegitimate PM of Thailand, joint the protestors  and gave speech on the stage.

Then all the jeers turned to cheers. Why? because there’ re no Thai PMs have said as  clear as Abhishit before about this.

international law, memorandum of understandings,  and treaty  which bind his country’s relationship, cooperation, and friendship to secure peace and solidarity with other nation.  He again speaks about 2000 MoU’s revocation and war.

“The 2000 MoU prevents the two sides from doing anything in the disputed areaand this is why the MoU should remain in effect,” Mr Abhisit said in a live telecast debate between a government side led by him and the civil society group this morning.

He said the memorandum does not accept Cambodia’s map.

“Don’t worry about the future as the Thai government will continue protecting the country’s sovereignty,” he said.

As for the encroachment issues near the disputed border around the ancient Preah Vihear temple, the prime minister said the government would take necessary preventive measures.

He said arrests were made when people encroached into the area in 2008 and there were clashes in April last year because of the same reason.

The premier said he had instructed Foreign Minister Kasit Piromya to hold talks with Defence Minister Prawit Wongsuwon and the military to seek diplomatic means to deal with the situation.

Resorting to force would be the last option as we have to look at the consequences between the two countries,” Mr Abhisit said.

NOTE:  Regarding to his statement above I want to response to Abhishit that:

  • It’s correct that MoU does’t allow any country to move into the disputed zones, but the land surroundings of Prasat Preah Vihear, no disputed zones exist over there since they are clearly stated by Siamese-French map 1908, in annex I map. This map is used by ICJ in 1962. So it was Thailand that raises the disputed zone in order to justify its invasion on Cambodia.
  • You must be crazy, Abhishit! Cambodia doesn’t have her own map. The map that Cambodia uses is the map drawn by French-Siamese committee and it is the international recognized map that Cambodia legitimately always uses it.
  • You said your govt will continue to protect your country’s sovereignty, but who violates your nation’s sovereignty?
  • The clashes that happened so far were not about Cambodia encroached your country, but they were about your country invade Cambodia. Let’s ask the world about this!
  • Military is the last resort?  You must be crazy, Abhishit.  You have already sent your troops to invade Cambodia and the clashes have already occurred twice so far. You would be a good neighbor to Cambodia if then you sent only delegates to negotiation diplomatically. I believe that there must be no military clashes between our two countries and things would be cordially easier to solve.

Look at them, they are freely holding demonstration which is banned by Emergency Degree declared by Abhisit’s govt since  May 2010 during the Red protest in Bangkok. Judging from this, how can we expect these scambag people to respect the international laws while they ignore  the laws in their own country.

With this, I do agree with former Siamese prime minister Chuan Leekpai who clearly said that: ” Siamese people’s disrespect for laws is the root of all country’s current problem.”

In response to his alliance extremist PAD’s call to revoke 2000 MoU and retake the lands around Prasat Preah Vihear at the protest  site, Abhishit clearly made his political stance against Cambodia that the last resort he will take is to use both democracy and military.

“About the land encroachment, we will cancel the MOU if the problem can’t be settled. We will use both democratic and military means,” Abhisit said, referring to the plot near the temple.

NOTEReading the statement from Abhishit we can understand that:

  • The democratic means”  means that the democracy in his camp -the extremist PAD.
  • The military means” means full invasion on Cambodia to retake Prasat Preah Vihear and the surrounding lands.
  • Abhishit and those extremist PAD must understand that in article VIII of the 2000 MoU, it prohibits a  state party involved from revoking it unilaterally.

So let’s see if the world allow him and his extremist group to carry out such an illegitimate means against other nation in this 21th century.

Thailand Is Waiting For Appropriate Time To Talk With Cambodia – Suthep

BANGKOK, Deputy Prime Minister Suthep Thaugsuban said that Thailand is now waiting for an ‘appropriate time’ to hold talks with itsneighbouring Cambodia over the Preah Vihear temple dispute, Thai News Agency said Thursday.

“The talks could be held later when both nations are more calm, and that is why Thailand did not reserve the right to begin talks,” he said when asked to comment on Prime Minister Abhisit Vejjajiva’s statement on Wednesday.

Abhisit said he was ready to assign his deputy Suthep Thaugsuban to hold talks with Cambodia on the Preah Vihear dispute if the Khmer leadership gives a positive signal for negotiation.

Tension between Thailand and Cambodia rose after the Thai government’s delegation objected to Cambodia’s unilateral management plan of the ancient temple as the two neighbours could find no common ground to settle the disputed 4.6 sq km of land adjacent to the temple which was granted world heritage status in 2008.

The United Nations Educational, Scientific and Cultural Organisation (UNESCO) through its World Heritage Commission (WHC) consequently last week postponed its discussion of the plan until next year when it meets in Bahrain.

Regarding to the ongoing conflicts caused by Thailand after Abhisit and his extremist alliance PAD have tried  hard to reclaim Prasat Preah Vihear, demand for joint listing of World Heritage Site for Prasat Preah Vihear and the joint management plan of the temple is that Abhishit shamelessly claims that the best resolution to end the conflict is to co-manage the temple.

On Sunday, Mr Abhisit said the best solution is to change the arrangement, from having Cambodia solely register the temple to  the two countries jointly proposing that the World Heritage site be co-managed.

NOTE: It’s a shame for Abhisit to ask for such a co-management over Prasat Preah Vihear Khmer, the property that you doesn’t belong to you. Does such a thing happen anywhere in the world? Impossible!

I also want to ask Abhisit and Thais people if we Khmer are allowed to join co-management of Prasat Phnom Rong and Prasat Pimai which built by our ancestors-the Khmer Kings?

Actually, the resolution is very easy if Abhisit stop being arrogant and just learn to respect the international treaty, law, agreement, MoU, and agreement, then all the conflicts will be ended.

Actually, on the substance of Tulsie’s opinion piece in The Nation on why Abhisit is acting tough now BP thinks Tulsie is basicallyright so do not have a dispute with that, but then there is this:

Defending its decision to support Cambodia’s registration efforts, the Samak government pointed to two basic legal points. The first was the World Court ruling in 1962 declaring that the temple was on Cambodian territory. The second was Article 61 of the World Court ruling, which states: “No application for revision may be made after a lapse of 10 years from the date of the judgement.” Article 61 featured prominently in Cambodia’s application document to Unesco, with “LAPSE OF TEN YEARS” written in capital letters).

The Democrat camp led by Abhisit at the time pointed out Article 60 of the court’s ruling. This article allows warring parties to reserve doubts and observations concerning rulings and, unlike Article 61, this one does not spell out any time frame. Which article carries stronger weight is debatable, but the battle line was clearly drawn. The Democrats were saying that any Thai move that could weaken Thailand’s “silent protest” against the World Court ruling had to be avoided.

BP: Ok, He has Article 61 correct, but lets look at Article 60 (it is actually Article 60 of the ICJ Statute and not the court ruling) states:

The judgment is final and without appeal. In the event of dispute as to the meaning or scope of the judgment, the Court shall construe it upon the request of any party.

BP: What is in dispute about the scope of the decision? The key part of the Court decision (see this post for more):

“The Court however considers that Thailand in 1908-1909 did accept the Annex I map as representing the outcome of the work of delimitation, and hence recognized the line on that map as being the frontier line, the effect of which is to situate Preah Pihear in Cambodian territory

BP: So Thailand will go back to the ICJ and ask, did you really mean it when you said that the temple is in Cambodian territory? There is nothing vague about this. See this post as for a critique by someone else at The Nation on trying to use Article 60. Actually, Thailand doesn’t dispute this at all per this document from from the MFA:

Thailand accepts that the Temple belongs to Cambodia as it honors the ICJ’s decision on the matter.

BP: Now, there is argument, which the ICJ didn’t address, about whether the land boundary between Thailand and Cambodia is, is this what the Democrat party argument is? The ICJ didn’t address this in details (although it did mention about Thailand accepting the Annex 1 map) so is there really an  argument for going back to the ICJ to determine the scope of the ICJ decision? Does Thailand really want to given that this would put more territory up for grabs?

Thanong in The Nation:

Thailand appears to be totally isolated on the issue. Most of the major powers are backing Cambodia on the management plan for the temple. This will allow interested parties a window of opportunity to take part in the development project for Preah Vihear, plus other business deals with Cambodia afterward.

Cambodia is trying every means to squeeze the territory from Thailand. The implication from this Unesco meeting is significant, for the claim over the land territory will have implications for maritime claims in the Gulf of Thailand, which are rich in oil and natural gas deposits.


If Cambodia insists on managing Preah Vihear, Thailand should respond in kind by closing the borders and stopping all trade with its neighbour. This would be the first warning. Thai soldiers on the border are on high alert. If the first warning goes unheeded, we should reserve the right, under our sovereignty, to drive out any nationals infringing upon our land.

BP: You see the Kasit/PAD line of thought in that first paragraph? Foreign countries are conspiring against Thailand it seems (Question? Because UNESCO delayed the decision until next year does it not logically follow that these countries are stalling for more oil and natural gas or that Thailand is giving them something in return?)

On the second paragraph, from Article 2 of the UNESCO Convention:

11. No act or activity undertaken on the basis of this Convention shall constitute grounds for claiming, contending or disputing any claim to national sovereignty or jurisdiction.

BP: This is the conflating of two issues (Preah Vihear and the maritime claims) by Thanong. Now, the issues are related in terms of Cambodian-Thai relations, but a ruling by UNESCO does not then legally mean anything in relation to the maritime claims.

Abhisit to jusitify his claim and threats WHC!

Today Associate Press published that Thailand is ready to reinforce troop at Cambodian border if needed. Read it here. And below is the excerpt from the AP:

Thailand’s army is prepared to defend its border with Cambodia if a territorial dispute heats up, the prime minister said Wednesday, as the two nations were set to tussle on the diplomatic front at a U.N. meeting in Brazil.

The army is now ready to defend our sovereignty if breached,” said Abhisit after his weekly Cabinet meeting. He said he was appealing to members of UNESCO’s World Heritage Committee to remember the very purpose this committee was set up for. It should be a purveyor of peace and culture, not of tension and conflicts.”

NOTE: This act of troop reinforcement must be committed in order to justify his claim that, ” to remember the very purpose this committee was set up for. It should be a purveyor of peace and culture, not of tension and conflicts“, in the hope that UNESCO’s World Heritage Committee (WHC) would prove Thailand right, then,  invalidate Prasat Preah Vihear listing and reject the Cambodia’s management plan and .

Therefore, in the case of Prasat Preah Vihear conflict to those who really love justice and peace would say that  Abhisit and his extremist PAD are the real mastermind of  peace and war. And hope that  WHC won’t let their decision subject to these irrational threat and illegitimate action of Abhisit and his extremist alliance- PAD.

WHC would also consider that if Abhisit/Thailand is really a good neighbor to Cambodia, Thailand should not view Cambodia’s management plan as a conflict, in stead, Thailand should view it as a positive sign, then cooperate with Cambodia, and willingly urge the Border Committees of the two countries to faster the  border demarcation in accordance with international recognized  map, treaty and verdict as fast as possible in order to bring about the economic development for both countries in the provinces around this Prasat Preah Vihear of the World Heritage Site.   Then we are all surely at PEACE.

Thailand has nothing to fear from the World Heritage Committee meeting starting today in Brazil, a source says.

The meeting will discuss Cambodia’s management plan for Preah Vihear temple and its buffer zone.

Thailand has yet to see the plan, because it has not been distributed to committee members.

However, the source said any decision by the committee to back the plan is unlikely to affect Thailand’s territorial dispute with Cambodia over land near the temple.

Preah Vihear has been on Unesco’s world heritage list since 2008.

Thailand opposes the plan on the grounds that sovereignty over the buffer zone, the 4.6 square kilometre disputed area claimed by the two countries, has not been settled.

The source, who works on resolving border disputes between Thailand and Cambodia, said endorsement of the management plan would probably have little impact on the territorial dispute.

He cited the World Heritage Convention which says the listing of a world heritage site will not prejudice concerned parties’ right to conduct territorial disputes.

The source insists the world heritage work will not affect demarcation work in the area as both sides reached agreements following a memorandum of understanding on demarcation work in 2000.

The work has made little progress so far, because they first need to identify all 73 land pegs running along the Thai-Cambodia border.

I think we need to study the law so we can deal with the issue better. At the moment, emotions are running too high,” the source said.

However, he cautioned about possible encroachments on Thai territory by Cambodia following any plan endorsement. Read more of this post

The Nation Mourns

According to the content of Bangkok Post it means the nation mourn for the lost of burnt billion dollar buildings, but not the lost of human life (Partly collapsed Central World)

The Bangkok Post, the biased news of pro-Thai elite and royalist, published an article in the front page titled:The Nation Mourns, on 21 May 2010 which I tried to avoid reading it many times when I surfed the site but at last I decided to read it  and ridiculously found it contradicted to its unique title. Please read the whole article HERE.

The Nation Mourns” doesn’t mean to mourn the lost of the civilian life during the crackdown ranges, but it seems to mourn the lost of elite’s property burnt down in the economic center of Bangkok and to put more blames on the poor RED. Why? Please observe in the followings:

  1. The Bangkok Post of the elite clearly doesn’t specify what they are mourning about. It just states: “Level of chaos catches government off-guard / A nation mourns. Death toll climbs to 52 in 6 days of bloodshed / Arms stockpiles found at abandoned sites”. Here the word “mourn” just appears twice in the whole article: (1) the title and (2) the sub-title with no clue to what it is emphasized on and the rest of the article just goes to something else for its own cause as usual.
  2. It published only pictures of the burnt buildings from the beginning to the end of the article, included some elements that the yellow and Abhisit govt are trying to use as evidence to justify their violence and accusation against the RED shirts as “violence”, “buffalo“, and  ”terrorists” with some pictures of military operation equipped with modern war weapons seemingly confronting an Al-Qaida or a war in Iraq. In this sense it seems that the Bangkok Post values property lost more than the lost of the civilian life in the 6 days bloodshed. And it’s even more ridiculous that Bangkok Post forgets to include dozens of civilian and soldiers killed in the bloodshed on 10 April 2010.

As the voice of human being in the civilized world, in this sense, Bangkok Post should stay out of politics, if not in its nature, but just this one in order to fit with its article’s title and honor the death whether they are RED, multi-color, yellow,  or soldiers because they are all just Thai and even the foreign journalists who died in the cause. To be reasonably correct, it should  focus on the content which express the feeling of “SORRY” or “CONDOLENCE ” as a nation to appease and console the family of the death and voice its concern towards govt to avoid such a lost in any future of political crisis.

For me I’d like to share my condolence to all the families of the death as a friend, a citizen of a neighboring country,  and the same human being, and more than that to the RED, even they were rioting in the last fight which led to torching down some buildings and looting something, I am still sympathy for them because as I have observed the red violence occurred only after military crackdown violently carried out against them, for instance, the event on 10 April 2010 which as we know happened only after militay moved in to retake the rally compound under its so-called emergency law and the event in this moth which surely happened only after threes causes threatened: (1) the govt cut off all supply road to protesters and moved in military, (2) most important factor Seh Daeng was assassinated, and (3) military moved in to crackdown on protesters’ site and more indiscriminate killing carried out by the military. And remarkably not all of the red involved in the violence.

Whereas, the accusation of the Bangkok elite and Abhisit govt that this blast that blast hit by M79 related to RED shirt, that black clad militant,  those snipers shot soldiers and civilians are groundless since they have never been able to produce any reliable evidences except one-sided accusation.

It has been quiet for a while concerning  with the conflict between Siam and Cambodia over the Siamese invasion on Preah Vihear Khmer temple. Now it starts again when Cambodia is cheduled to submitt its administrative and conservative plan to UNESCO.”  The Nation has it below:

Since Cambodia was to propose the administration and conservation plan for Preah Vihear on February 1, PM Abhisit Vejjajiva should express Thailand’s stance that Thailand has never agreed and joined in the plan making, an academic said Monday.

Well, we Khmer know that the theift never gives up stealing. So it doesn’t need you to reassure it to us. However, you Siamese people should also know that Cambodia has never asked you to join the plan or care whether you Siam agree or not with it, because Preah Vihear khmer temple has nothing to do with you Siam.
